6. How Do I Know Which Claim Form To Use?
To receive a payment, you must submit an online Claim Form. Depending upon your situation and circumstances, you will be eligible to submit a claim either for the Statutory Damage Fund or the Dispute Resolution Damage Fund. If you are eligible to submit a claim for the Dispute Resolution Damage Fund, you have a choice between the Long Claim Form or the Short Claim Form. The information provided directly below may help you in determining your eligibility between the two funds, and if you are eligible as a "Dispute Resolution Claimant," in making your decision regarding the two claim forms for the Dispute Resolution Fund.
a. Dispute Resolution Claims (Long Form and Short Form Claims):
You are a "Dispute Resolution Claimant" and can make a Long Form or Short Form claim if you:

experienced or reported to PayPal an unauthorized or incorrect electronic transfer to or from their PayPal account including, without limitation, electronic transfers initiated by (a) you ; (b) PayPal in connection with, among other things, chargebacks, refunds, buyer complaints, PayPal's Seller Protection Policy, Buyer Complaint Process and/or Buyer Protection Policy; or (c) any third party;

(ii)

had access to your PayPal account improperly, incorrectly or erroneously limited or restricted, in whole or in part; or

(iii)

made a request for information in connection with PayPal's restriction or limitation of your PayPal account or regarding an incorrect or unauthorized electronic transfer to which PayPal did not respond at all or did not respond to your satisfaction.

Long Form Claim, you will have the opportunity to provide documentation in support of your claim and thus may be able to receive a larger amount. Both the Long Form Claim Form and the Short Form Claim Form requires you to provide certain identifying information and sign a statement under penalty of perjury authenticating your claim, which may be subject to verification by PayPal's records. The amount paid out for Long Form and Short Form claims will depend on the number of claims received and the aggregate amount of such claims. For more details, review the Plan of Allocation.
b. Statutory Damage Claims
If you are not qualified to make a Long or Short Form Claim (Dispute Resolution claim), you can make a claim for a payment from the Statutory Damage Fund. The Statutory Damage Fund Claim Form requires you to provide certain identifying information and sign a statement under penalty of perjury authenticating your claim, which may be subject to verification by PayPal's records.
